SUBCHAPTER I. GESTATIONAL AGREEMENTS
What you should know:

Parentage is ordered (pre-birth order) with the gestational agreement being validated by the court, mid-pregnancy, per its contractual requirements for surrogacy.

Intended Parents must be married to each other.

Intended Mother's or donor's eggs must be used. The gestational carrier may not use her own eggs.

A gestational agreement may not limit the right of the gestational mother to make decisions to safeguard her health or the health of an embryo.

The Intended Mother must have a medical or mental health issue issue that reasonably prevents her from carrying the pregnancy safely.
